General terms and conditions

Preamble

The present conditions apply to, on the one hand, to CACHE CŒUR SARL with a capital of 37000 €, which head quarter is located ZI de Kerscao – 29480 LE RELECQ-KERHUON, registered at the “Registre du Commerce et des Sociétés” of Brest, under the number RCS of Brest 502 110 034, hereinafter referred to as “CACHE COEUR”, and on the other hand, to customers wishing to place an order through Cache Coeur’s website www.cachecoeurlingerie.com, an e-commerce site, and hereinafter referred to as named “the buyer”.

 

 I/ Satisfied or reimbursed - Make a return

In accordance with the French Consumer Code, the buyer benefits from a 14-day cooling-off period, starting the day of delivery, to cancel and return the order and to return the ordered articles without any declaration of reasons or any penalty fee. However, the return costs are at the buyer’s expenses. If several articles ordered on the webpage www.cachecoeurlingerie.com  have been shipped in one parcel and if the buyer decides, within the 14-day money back guarantee, to return all of them, the delivery fees will be reimbursed. However, if only one part of the ordered articles shipped in one parcel are returned within the 14-day money back guarantee, the delivery costs have to be borne by the buyer.

For hygiene reasons, the Secret By products and the maternity tights will not be returned, refunded or exchanged

- Your name and surname

- Order number: you can find it on your order confirmation email

- Items affected by the exchange or refund

The exchange is accepted only for France

Refund is possible in all countries

In any case the articles have to be returned in their original packaging, complete, labelled, new, unworn, unwashed and accompanied by the return bordereau carefully completed to the following address:

Returned articles which do not correspond to the conditions listed above (original packaging, complete, labled, new, unworn, unwashed) or articles which are worn, damaged, deteriorated or soiled by the buyer will not be reimbursed.

The client will always be in charge of the costs and the risks of reshipment. The buyer is hereby urged to return the parcels with a mode of transport that proofs the sending and gives him a certain date (advised is registered mail, observed express mail, etc….)

If the reshipment is due to a mistake of Cache Coeur, the shipping costs that have been paid by the buyer will be reimbursed.

Once the goods received have been controlled and accepted by our services, the reimbursement of the returned and invoiced articles will be credited on the client’s bank account that has been used for the payment, as soon as possible and within 14 days after reception at the latest.

Conform to the article L.121-20-2 of the French code of consumption, this authorization to cancel the order will not come into effect, if the cosmetotextile products (e.g. Textiles containing slimming microencapsulated agents) have been opened.

 II/ Safe payments

 The price charged to the customer is the price indicated on the order confirmation issued by Cache Coeur.

The price of the products must be paid outright.

There are 2 ways to pay:

by credit card with the CB symbol, via the secured payment system of the CIC bank:

which is the only party knowing about your bank information. These confidential data do not pass through our website. Your order will be both registered and validated after the validation of the payment by the services of the CIC bank. You can pay online by filling in the fields provided for that purpose, with your credit card number and the expiry date. We have adopted the SSL cription system that assures the confidentiality of your bank data. It is impossible to read the data after they have been entered and transferred. Cache Coeur does not have access to your bank details and does not keep them on record on its servers.

By printing your order in paper form and by mailing it to Cache Coeur Service Client, ZI de Kerscao - 29480 LE RELECQ-KERHUON, either along with attaching the cheque made payable to “Cache Coeur”, or along with you credit card details - i.e card number, expiry date and CVV (3 digits at the back the credit card). Should the buyer decide to use one of the 2 methods mentioned above, the order will not be validated until reception of the order by Cache Coeur and the validation of payment.

The order validated by the buyer will not be considered as effective until the services of the bank concerned have given their accord. In the case these services deny to the payment, the order will automatically be cancelled and the buyer will be informed by email. Furthermore, Cache Coeur reserves the right to reject any order placed by a customer whom there has been previous litigation with. Invoices are issued along with the delivery of the goods.

 

III/ Delivery conditions

Cache Cœur commits to deliver the ordered goods to the postal services within 2 working days.

Delivery will be made by SoColissimo registered 48 hours delivery service, with acknowledgement of receipt for France. The buyer can ask for the goods to be delivered to their domicile, office, a third party, his holiday residence, etc. He also benefits from the right to have the ordered goods delivered to another physical person of their choice. For France and up to 2 articles ordered, Cache Coeur can use Distingo services at the same price condition than Colissimo registered. A participation fee of 5.5€ for France (free for orders of 100€ and beyond) and 10€ for outside France is required. The post will deliver the goods to the address the buyer gave to Cache Coeur.

No delivery to P.O boxes (Post Office Boxes), camping or hotel can be made. In case of absence at the reception, the parcel will be held at our local Post Office for 15 days. After this period, the parcels will be returned to us. In this special case, a credit note of the ordered amount (excluding shipping costs and processing costs) will be issued and remain valid 2 months from the day of its creation.

 

Delivery outside Metropolitan France:

Cache Coeur requires a participation fee for all shipments in France, as well as international shipments and shipments to DOM TOM by Colissimo International. The tariffs depend on the amount of goods sent and the delay depends on the served area.

Tariffs and deadlines are indicated at the moment the order is placed, before validation. 
For deliveries outside Metropolitan France, the buyer agrees to pay all import taxes of the goods, customs duty, value added tax and other taxes due under the laws of the ordering country. All orders placed with Cache Coeur are intended to the personal use of the clients. It is strictly forbidden for clients or recipients of the products to resell a part or all of the products. Cache Coeur is not liable to the nonpayment of taxes by the customer. Cache Coeur reserves the right not to deliver certain areas, function of the feasibility of a delivery.

 

Delay or Loss: 
Cache Coeur will indicate, before the conclusion of the contract, the latest date by which it will deliver the goods or execute the services. 
Shouldn’t the goods be delivered by the indicated deadline, the customer can obtain the termination of the contract accordingly to the terms described in paragraph 2 and 3 of Article L. 114-1 of the French Consumer Code. He will then get reimbursed under the conditions of L. 121-20-1 the French Consumer Code. 
However, Cache Coeur does not take any responsibility for any delay in delivery due to postal services or means of transport, neither for the loss of ordered products or strike. 
The goods always ship at the recipient’s risk. Always check your parcel on arrival. You have a period of 3 working days, exclusive of holidays, after the delivery of the product to make a reservation by the carrier in case of missing or damaged goods. A copy will be immediately sent to the company Cache Coeur.  
For reasons of availability, an order can be delivered to the customer in several parcels. See General Sales Conditions Article 4 - validity conditions.

 

Missing or damaged products: 
Despite the care taken by Cache Coeur in preparing the parcels it is possible that a product is damaged or missing after the transport of goods. The Buyer will therefore verify systematically the compliance of commodities. Any anomaly concerning the delivery (product missing or broken, damaged packaging) must be notified within 3 working days, exclusive of holidays, after delivery of the product, a copy will be immediately sent to the company Cache Coeur.

If no claim is made within the legal delay, no action can be undertaken against the carrier accordingly to Article L 133-3 of the French Commercial Code. 

It is the buyer’s responsibility to make sure that the items that were delivered correspond to the order. In the event the goods delivered do not conform in kind or quality to the specifications described in the delivery slip, the buyer must notify by telephone the e-boutique Customer Service of Cache Coeur and return the items to the address and in the manner provided in Article 8. 

In case of an electronic selling, no claim of any kind can be processed in the e-boutique.

V/ Protection of Data Privacy
Intelligence information collected for purposes of distance selling are required. When an order is placed on the website www.cachecoeurlingerie.com by any new client, the information collected is added to the data base "Clients", this information is essential for orders processing and delivery. It allows us to better meet the client’s expectations and to facilitate technical assistance. 
This database has been the subject of a statement in compliance with the Act of 6 January 1972 on Data Processing, Data Files and Individual Liberties as amended by the Act of 6 August 2004, you have the right to access, modify, rectify and delete your personal data by sending a mail to the following address:

They can be printed by following the instructions on the client’s web browser.

The www.cacheceourlingerie.com site is intended for consumers. The purchase of the product (s) by a professional with the aim to resale is forbidden.

Article 3 - Information from the consumer. 
In accordance with Articles L 111-1 and L 113-3 of the French Consumer Code, the essential characteristics and prices of our products sold electronically are available on the website  www.cachecoeurlingerie.com or at our outlets indicated at :

In addition, the buyer receives the information specified in Articles L 121-18 and L 121-19 of the Consumer Code, prior to and subsequent to the completion of the sale in particular by these terms and conditions of which he declares to have knowledge of before confirming the order and to which he has access to from the site www.cachecoeurlingerie.com and by reference in e-mail confirmations and shipment of the order sent to him.

 

Article 4 - Product, Price and Validity. 

Product

The company Cache Coeur declines any responsibility for the consequences of a malicious act caused by a third party leading to a modification of the content of the website.  
In the case of a lack of availability of a product, Cache Coeur will inform the buyer as soon as possible. 
If an ordered and paid product is delayed by 30 days or more, the buyer will be informed by email. The cancellation of the order of this product and its repayment will be made, the remaining products of the order will be considered as definitive.

 

Prices

Prices are quoted in Euros (€).

Prices that are indicated in the product information file do not include transport costs.

The price indicated in the order confirmation is the final price, all taxes and including VAT for France and the EU countries. This final price includes the price of the product, the handling charges, packaging and conservation of the product as well as the shipping charges.

Until full and complete payment, the products remain the property of Cache Coeur.

Any change to the applicable rate will automatically come into effect on the price of the products.

After this date, all prices are subject to change. However the prices cannot be changed the customer order placed.

 Similarly, if one or more taxes or contributions, including environmental, had to be created or modified, up as down, this change will be reflected in the price of selling items on the company website and sales documents. Prices of product on the website after references catalogs they come from and the date specified in question are authentic.

 

Conditions of validity

The products for sale on the website www.cachecoeurlingerie.com are available as long as stocks last. If one or several articles are no longer available, the buyer will be informed as soon as possible. In this case the buyer can choose between keeping the rest of his command going or cancelling the order completely. If the credit card has already been charged, the amount concerned will be credited on the credit card used for the payment within a maximum of 14 days.

 

Article 5 : Order

The systems of automatic booking are considered evidence concerning the nature, content and date of an order. Cache Coeur will confirm the order by an email to the address that has been communicated to Cache Coeur. The sale will only be concluded with the confirmation of the order and the validation of the payment by the bank services concerned.

 With the form for the opening of his account, the communication of his personal data, the number of his credit card, the confidential data related to it and with the validation of his order, the buyer is bound to the presented conditions of the contract, in application with article 1316-1 of the “French Code Civil”.

If there has been a litigation regarding the payment of a previous order, Cache Coeur reserves the right to cancel the order. Information quoted by the buyer when placing the order lead to the following:

In case of spelling mistakes regarding the data of the addressee, the seller cannot be held responsible for not delivering the product. Any order means the acceptation of the general sales conditions, the prices and the product descriptions disposable with the sale. 

 Article 6 : Safe payments

 The invoiced price for the client is the price indicated on the order confirmation of Cache Coeur.

The price is due when the order has been fulfilled.

The payment can take place in 2 ways:

- by credit card with the sign CB, via the secured payment system of the CIC bank:

Being the only part knowing your bank information, the confidential data will not be transmitted to our side in any case. Your order will be both registered and validated after the validation of the payment by the services of the CIC bank. You can pay online, entering the number and the expiry date of your bank card in for this purpose previewed emplacements. We introduced the SSL system that assures the confidelity of your bank data. It is impossible to read the data after they have been entered and transferred. Cache Coeur does not have access to your bank details and does not safe them on its servers.

By printing your order in paper form and by sending it to Cache Coeur Service Client, ZI de Kerscao, 29480 LE RELECQ-KERHUON by post, attaching the cheque for the payment of the order of “Cache Coeur”, or attaching the precise number of your bank card, its expiry date as well as the 3 cryptic numbers (3 figures at the backside of your bank card). In the case the buyer decides to use one of the 2 methods mentioned above, the order will not be validated before the receipt of the order by Cache Coeur and the neither before validation of payment.

The order validated by the buyer will not be considered as effective until the services of the bank concerned have given their accord. In the case these services refuse the payment, the order will automatically be cancelled and the buyer will be informed by email. Furthermore, Cache Coeur keeps the right to refuse any order of a client with whom there has been litigation previously. The invoices will be sent with the delivery of the goods.

 

 Article 7 - Delivery conditions

Cache Cœur is engaged to deliver the ordered goods to the postal services within a period of 2 working days.

The delivery will be effected by SoColissimo within 48 hours within France. The buyer can ask for a delivery of the goods to his domicile, his office, a third party, his holiday residence, etc. He also disposes of the right to ask for a delivery of the goods to a person of his choice. For France and just up to 2 ordered articles, Cache Coeur can use the services of Distingo at the same prices like Colissimo as follows. The buyer has to pay a part of the shipping and handling fees for France:  
from 5,50€ (this part will be free for all orders exceeding 100€) and from 10€ outside France. The post will deliver the goods to the address of the buyer gave to Cache Coeur.

Delivery to a post-office-box, to a camping site or a hotel cannot be effected. In case of absence for the reception, the parcel will be kept at the Post Office for 15 days. After this period, the parcels will be returned to us. In this special case the ordered amount (excluding shipping costs and processing costs) will be edited and valid 2 months from the day of its creation.

 

Delivery outside of France Métropolitaine: 

Cache Coeur requests a participation fee for all shipments in France, as well as international shipments and shipments to DOM TOM by Colissimo International. The tariffs depend on the amount of goods sent and the delay depends on the served area.

All orders placed with Cache Coeur are intended for the personal use of the clients. It is strictly forbidden for clients or recipients of the products to resell parts of the products or complete products. Cache Coeur does not take any legal liability if the payment of taxes was not made by the buyer. Cache Coeur is authorized to not deliver certain  destinations based on the feasibility of the shippment.

 

Delay or Loss: 
The company Cache Coeur will indicate, before the conclusion of the contract, the latest date by which it will deliver the goods or execute the services. 
If the goods do not reach the customer at the deadline, the client can cancel the order under the conditions provided in the second and third paragraphs of Article L. 114-1 of the French Consumer Code. He will then be reimbursed under the conditions of L. 121-20-1 of the French Consumer Code. 
However, Cache Coeur does not take any responsibility for any delay in delivery due to postal services or means of transport, neither for the loss of ordered products or strike. 
The goods are always shipped at the risk of the recipient. Always check your parcels on arrival. Missing or damaged products: 
Despite the care taken by Cache Coeur in preparing the parcels it may happen that a product is damaged or missing after transporting the package. The Buyer shall systematically check the conformity of the received products, any flaw concerning the delivery (missing or broken product, damaged parcel) will necessarily have to be notified within 3 working days, excluding holidays, after the delivery of the product, by e-mail to contact@cachecoeurlingerie.com, a copy will be immediately sent to the company Cache Coeur. 

The failure of complain within the mentioned delay shall extinguish all rights of action against the carrier in accordance with the provisions of Article L 133-3 of the French Commercial Code. The buyer must ensure that the items that were delivered correspond to the order. In the event that the goods delivered do not conform in kind or in quality as to the specifications in the delivery order, the buyer must notify by phone (+33) (0)2 98 80 12 95 or by e-mail to contact@cachecoeurlingerie.com , the Customer Relations Department e-boutique of Cache Coeur and return the items to the address and in the manner provided in Article 8. 

When the purchase has been made online, no complaints of any kind whatsoever can be dealt with physical stores.

 

Article 8 – Return Policy

In accordance with the articles L 121-20 and seq. to the French Code of Consumption, the buyer profits from a 14-day reflection period from the day of delivery, to exercise his right of withdrawal and to return the ordered article without having to give any reason or incurring penalties, except, if necessary, return costs. If several articles ordered on the webpage www.cachecoeurlingerie.com  have been shipped in one parcel and if the buyer decides, within the cooling off period, to return all of them, the outward delivery costs will be reimbursed. However, if only one part of the ordered articles shipped in one parcel are returned within cooling off period, the delivery costs have to be borne by the buyer.

In any case the articles have to be returned in their original packaging (if possible), complete, labelled, new, unworn, unwashed and accompanied by the return slip carefully completed to the following address:

The return slip has to be requested by the client by e-mail to the following address: contact@cachecoeurlingerie.com or by phone: 0033 298 80 12 95.

Returned articles which do not correspond to the conditions listed above (original packaging (if possible), complete, labelled, new, unworn, unwashed and accompanied by the return slip) or articles which are worn, damaged, deteriorated or soiled by the buyer will not be reimbursed.

The client shall always be responsible for the costs and risks relating to a return. The buyer is hereby urged to return the parcels by any means that proofs the sending and provides him the specific date of its return (recommended letter with receipt notice, advised is registered mail, by Colissimo with tracking, etc….)

If the reshipment is due to a mistake of Cache Coeur, the shipping costs that have been paid by the buyer will be reimbursed.

Once the goods received have been controlled and accepted by our services the reimbursement of the returned and invoiced articles will be effected as soon as possible by bank cheque, within 14 days after reception of the goods at the latest.

 Article 9 - signatures and proofs

 In any case the on-line provision of a credit card number and the order’s final validation will constitute proof of the whole order in accordance with the law of 13 March 2000 and will cause the sums incurred for the amount quoted on the order form to become due and payable. The computerized databases preserved in the information electronic systems of the company Cache Coeur and its partners under reasonable conditions of safety, will be regarded as the evidence of the communications and of the orders and payments occurred between the parts.

 

Guarantee

A legal guarantee of conformity (Art. L211 of the French Code of Consumption) and a guarantee against hidden deficits (articles 1641 and the following of the “French Code Civil”) are given for all articles allowing the reshipment of defective articles. Nevertheless, specific conditions of guarantee are given to the client with the delivered article, the articles sold via the website www.cachecoeurlingerie.com are subject to the legal conditions for guarantees.

The company Cache Coeur cannot be held liable:

-in case of a lack of the obligations resulting from the contract due to random circumstances or a force majeure

-for insignificant differences between the photos, texts and illustrations of the article on our website and the delivered articles.

The liability of Cache Coeur is systematically limited to the value of the product concerned, the value at the date of the sale and there is no possibility to take legal actions against the brand or the producing company.

 

Responsibility

The company Cache Coeur has an obligation of results at all steps when accessing the website, when processing the order as well as at posterior steps at the conclusion of the contract. Cache Coeur commits to describe the products being sold on the website www.cachecoeurlingerie.com as accurately as possible.

However, Cache Coeur cannot be held liable for not executing their obligations in the event the non-execution of their obligations is directly imputable to the unpredictable and insurmountable actions of a third party, or due to force majeure as described by French Jurisprudence. Furthermore, Cache Coeur cannot be held liable for any inconveniences or damages inherent the use of the internet, neither for a rupture of service, an external intrusion or an electronic virus.

 

 Nominative Data

The provision of information of nominative data collected at the end of a sale via the internet is obligatory. These information are indispensable for the processing and the transportation of the orders. Furthermore, they allow to better come up to to the customers’ expectations and lead to better services.

In any case, any link, even if tactically authorized, has to be removed if Cache Coeur asks for its removal.

Hyperlinks can lead back to other websites than the website of Cache Coeur. Cache Coeur disengages itself from any responsibility in the case of illegal websites or illegal contents of the websites.

 

Invalidity

If one or more of the clauses of the existing contract are nullified by a change of the legislation, the regimentation or a legal decision, this will have no effect on the validity of the presented general sales conditions.

 

Integrity of the contract

The presented general sales conditions and the aggregation of the order transmitted by the buyer create a contractual entity and constitute the integrity of the contractual relations between the parties.

If the documents are contradictory the general sales conditions become decisive.

 

Duration

The present conditions apply during the whole time the products offered by Cache Coeur are online.  

 

Force majeure

Cache Coeur is not responsible for any partial or complete non-execution of the obligations emerging from the contract, if this non-execution is caused by a force majeure, in particular it is caused by perturbation or by a partial or complete strike of the postal services, modes of transport and/or communications, flood or fire disaster.

Events that correspond to the criteria described in the case law of the Court of cassation shall be regarded as a force majeure.

In the case of a force majeure, Cache Coeur will inform the buyer within 5 working days about the apparition or the menace of such an event.

The parties agree on informing each other as soon as possible to determine together the modalities for the order execution in case of a force majeure.

Beyond a delay of one (1) month of interruption caused by a force majeure, Cache Coeur can decide not to proceed the order but to reimburse the buyer instead.
